En consecuencia, se ordenó remitir la tutela propuesta por el ciudadano de la referencia a la Sala de Decisión Penal del Tribunal Superior de Riohacha, por ser ese despacho judicial el superior jerárquico ante el cual se interpuso el recurso de apelación contra la acción de tutela en referencia.

- Primero. Inaplicar, en relacion con las acciones de tutela a que se refiere esta providencia el articulo 1o del Decreto 1382 de 12 de julio de 2000, por ser contrario a la Constitucion Politica conforme a lo expuesto en la parte motiva de este auto.
- Segundo. ORDENASE REMITIR la accion de tutela propuesta por el ciudadano Jorge Elias Lopez Varela contra el Juzgado Promiscuo de Familia de San Juan del Cesar, el Dr. Hugues Daza Sabaleta Magistrado de la Sala Administrativa del Consejo Seccional de la Judicatura de Riohacha y el Dr. Ivan Fuentes Acosta, Secretario de esa misma Corporacion, a la Sala de Decision Penal del Tribunal Superior de Riohacha, por ser ese despacho judicial el superior jerarquico ante el cual se interpuso el recurso de apelacion contra la accion de tutela en referencia.
